Welcome to Nicole Hutchins Art. This website displays original artworks and allows customers to purchase available paintings.

By using this website you agree to respect the artist’s work, intellectual property, and the terms outlined below.

  • Artwork & Copyright

    All artwork, images, and content on this website are the intellectual property of Nicole Hutchins.

    This means:

    • Artwork cannot be copied or reproduced

    • Images cannot be used for commercial purposes

    • Artwork may not be used for AI training, NFTs, or reproduction without written permission

    Sharing artwork on social media is welcome provided proper credit is given to Nicole Hutchins Art.

  • All artworks listed for sale are original physical paintings unless otherwise stated.

    Please note:

    • Colours may vary slightly depending on your screen.

    • Each artwork is unique and cannot be exactly reproduced.

    • Once an artwork is sold it is place in the SOLD gallery.

    Payments are securely processed via Square.

  • Orders will be carefully packaged to ensure artwork arrives safely.

    Shipping times may vary depending on location and courier services.

    All works under 100cm will be shipped via Australia Post.

    Tracking will be provided where possible.

  • Due to the unique nature of original artwork, change-of-mind refunds may not be offered, please contact Nicole Hutchins Art.

    If artwork arrives damaged, please contact Nicole Hutchins Art within 48 hours with photos of the damage so the issue can be resolved.

    Your rights under Australian Consumer Law always apply.

  • Reviews

    Customers may leave reviews about their experience.

    Reviews must be respectful and genuine. Inappropriate content may be removed.

  • Visitors may subscribe to the Nicole Hutchins Art newsletter to receive:

    • New artwork releases

    • Exhibition announcements

    • Studio updates

    Subscribers can unsubscribe at any time.

 

  • All original paintings sold through Nicole Hutchins Art are:

    • Hand-created by the artist

    • Unique pieces

    • Sold as physical artworks

    • Include a Certificate of Authenticity

    Ownership of the physical artwork transfers to the buyer upon purchase.

    However, copyright remains with the artist unless explicitly transferred in writing.

    This means the buyer may not reproduce the artwork for commercial use.

  • If Nicole Hutchins accepts commissioned work, the following terms apply.

    Commission Process

    1. Client discusses concept with the artist.

    2. Agreement on size, subject, and price.

    3. A deposit (usually 50%) is required before work begins.

    Changes

    Minor adjustments may be possible during early stages of the work. Major revisions after completion may not be possible.

    Completion & Payment

    Final payment is required before the artwork is shipped or delivered.

    Cancellation

    If a commission is cancelled:

    • Deposits may be non-refundable once work has begun.

    • Any completed work remains the property of the artist.

    Copyright for Commissioned Work

    Unless otherwise agreed:

    • Nicole Hutchins retains copyright to the artwork.

    • The artist may display the work in portfolios, exhibitions, and online galleries.

  • If a client wishes to use artwork for:

    • prints

    • merchandise

    • publishing

    • branding

    a separate licensing agreement must be arranged.
